Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.

2. Account Registration

To access certain features of the Service, you must create an account using a valid email address and password. You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Subscriptions and Billing

3.1 Plans

The Service offers paid subscription plans, billed monthly or annually, as described on our Pricing page. Prices are subject to change with reasonable advance notice to existing subscribers.

3.2 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. By subscribing, you authorize us (via Stripe) to charge your chosen payment method on a recurring basis until you cancel.

3.3 Free Access

Creating an account does not grant access to image generation features. Generation features require an active, paid subscription.

3.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date. You may cancel at any time through your Account page or the Stripe customer portal; cancellation takes effect at the end of the current billing period, and you will retain access until that date.

3.5 Refunds

Except where required by law, payments are non-refundable, including for partial billing periods, unused generations, or account termination for a violation of these Terms. If you believe you were charged in error, contact us at support@scapebuilder.com.

3.6 Failed Payments

If a payment fails, we may retry the charge and/or suspend access to paid features until payment is resolved.

4. Account Deletion

Account deletion requires first canceling any active subscription, then emailing support@scapebuilder.com from your registered account address to request removal. We will process verified deletion requests within a reasonable time, subject to any data we are required to retain by law.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, infringing, defamatory, obscene, or that depicts real identifiable individuals without consent
• Attempt to reverse engineer, scrape, or interfere with the Service's underlying models or infrastructure
• Circumvent usage limits, subscription requirements, or access controls
• Upload or generate content that violates the intellectual property rights of others
• Use automated means (bots, scripts) to access the Service outside of any officially provided API
• Resell, sublicense, or redistribute access to the Service without our written consent

We reserve the right to suspend or terminate accounts that violate this section, without refund.

6. Generated Content and Intellectual Property

6.1 Your Content

Subject to your compliance with these Terms and payment of applicable fees, you own the output images you generate using the Service, to the extent permitted by applicable law and the terms of any underlying AI model providers we rely on.

6.2 Our Platform

The Service itself, including its software, design, branding, and underlying technology, is owned by ScapeBuilder and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or platform code.

6.3 No Guarantee of Originality

Given the nature of AI generated content, we cannot guarantee that any generated output is wholly unique or free from resemblance to existing works. You are responsible for ensuring your use of generated content complies with applicable law, including in commercial contexts.

7. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, including for maintenance, updates, or changes to underlying AI providers.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS OR BE ERROR FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAPEBUILDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless ScapeBuilder and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which ScapeBuilder operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in that jurisdiction.
